1. Acceptance of These Terms

Welcome to Jobsite.world (“Jobsite.world,” “we,” “our,” or “us”).

These Terms of Service (“Terms”) govern your access to and use of the Jobsite.world website, applications, features, and related services (collectively, the “Platform”).

By accessing or using the Platform, creating an account, posting a project, or contacting another user through the Platform, you agree to these Terms. If you do not agree, you must not use the Platform.

You must have the legal capacity to enter into a binding agreement to use the Platform. If you use the Platform on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

2. Description of the Platform

Jobsite.world is an online platform designed to help property owners, developers, contractors, construction professionals, and other users discover and connect with one another regarding construction projects and related services.

Depending on available features, users may be able to:

  • Create accounts and professional profiles.
  • Post construction projects and project descriptions.
  • Display project locations on a map.
  • Upload photographs, videos, and other project-related content.
  • Discover projects and professionals.
  • Express interest in projects or receive inquiries from professionals.
  • Communicate with other users regarding potential work opportunities.

We may add, modify, suspend, or discontinue Platform features at any time, subject to applicable law.

3. Jobsite.world Is Not a Construction Contractor

Jobsite.world is a technology platform, not a construction service provider.

Unless expressly stated otherwise in a separate written agreement, Jobsite.world does not:

  • Perform construction, engineering, architectural, inspection, permitting, or contracting services.
  • Employ, supervise, or control independent contractors or other professionals listed on the Platform.
  • Guarantee that a user holds a valid professional license, certification, insurance policy, or other qualification.
  • Guarantee the accuracy, completeness, legality, safety, or suitability of a project listing or professional profile.
  • Guarantee that a project will receive inquiries, that a professional will be hired, or that a construction project will be completed successfully.
  • Act as an employer, general contractor, construction manager, agent, partner, or joint venture participant of users merely because they use the Platform.

Users are responsible for independently evaluating other users and deciding whether to enter into any agreement with them.

4. Eligibility and Accounts

You agree to provide accurate, current, and complete information when creating an account or using the Platform.

You are responsible for:

  • Maintaining the confidentiality of your login credentials.
  • All activities conducted through your account, to the extent permitted by applicable law.
  • Updating your information when it changes.
  • Not impersonating another person, business, or professional.
  • Not creating accounts through fraudulent or misleading means.
  • Promptly notifying us of suspected unauthorized account access.

You must not use the Platform if your use is prohibited by applicable law.

We reserve the right to suspend or terminate accounts that violate these Terms, subject to applicable law.

5. Project Listings and Professional Profiles

Users are responsible for the content and information they submit to the Platform.

When posting a project or professional profile, you agree that the information you provide will be accurate to the best of your knowledge and will not be misleading, fraudulent, unlawful, or deceptive.

Project posters are responsible for providing appropriate information about their projects, including project scope, location, timing, budget, and requirements when applicable.

Professionals are responsible for accurately representing their experience, qualifications, licenses, certifications, insurance, and services.

You must not:

  • Post fictitious projects or fraudulent job opportunities.
  • Misrepresent ownership of a property or authority to offer a project.
  • Falsely claim to hold a professional license or certification.
  • Advertise services that you are legally prohibited from providing.
  • Use another person’s professional identity without authorization.
  • Post confidential information or personal information without appropriate authorization.
  • Publish duplicate, irrelevant, or misleading listings intended to manipulate the Platform.

Jobsite.world may review, restrict, remove, or decline to publish content that violates these Terms or creates legal, security, or safety concerns. We are not obligated to review every listing or verify every user.

6. User Conduct

You agree to use the Platform lawfully and respectfully.

You must not:

  1. Use the Platform for fraud, scams, harassment, threats, discrimination, or unlawful activity.
  2. Upload malware, malicious code, or content designed to compromise the Platform.
  3. Attempt to access another user’s account or private information without authorization.
  4. Interfere with the Platform’s operation, security, or availability.
  5. Scrape, copy, harvest, or collect user information through unauthorized automated means.
  6. Use another user’s information for unsolicited marketing, spam, or harassment.
  7. Circumvent applicable access controls or security measures.
  8. Upload content that infringes intellectual property or violates another person’s rights.
  9. Use the Platform to facilitate illegal construction activity or evade licensing, permitting, or building-code requirements.

We may investigate suspected violations and take appropriate action, including removing content, restricting access, or reporting unlawful conduct to the relevant authorities when appropriate or required by law.

7. User-Generated Content and Media

The Platform may allow users to upload photographs, videos, text, drawings, project documents, logos, and other materials (“User Content”).

You retain ownership of User Content to the extent that you own the applicable rights.

By submitting User Content, you grant Jobsite.world a nonexclusive, worldwide, royalty-free license to host, store, reproduce, display, distribute, and technically process that content as reasonably necessary to operate, maintain, secure, promote, and improve the Platform, subject to your privacy settings, our Privacy Policy, and applicable law.

This license includes permission to display project content to other users as necessary for the Platform’s intended functionality.

The license continues for as long as reasonably necessary to fulfill these purposes, including maintaining backups, complying with legal obligations, resolving disputes, and enforcing our agreements. Where technically feasible and legally required, we will honor applicable deletion rights.

You represent that:

  • You own the User Content or have permission to submit and share it.
  • Your submission does not violate another person’s intellectual property, privacy, confidentiality, or other legal rights.
  • You have appropriate permission to share photographs, videos, project documents, and information about properties or individuals shown in your content.

You must not upload content that you are legally or contractually prohibited from disclosing.

We do not claim ownership of your User Content merely because you use the Platform.

8. Project Locations and Mapping

Jobsite.world may display project locations on maps or use location information to help users discover projects.

You are responsible for ensuring that the location information you submit is appropriate to share publicly or with the intended audience.

Unless a feature expressly provides otherwise, map locations and location descriptions are informational and may be approximate. They should not be relied upon as a substitute for verifying property boundaries, addresses, ownership, site conditions, or legal access rights.

Do not publish a person’s private residential address or other sensitive location information without appropriate authorization.

Map services and geographic data may be supplied by third-party providers and may be subject to their own terms and privacy policies.

9. Independent Relationships and Transactions

Any agreement for construction, design, engineering, consulting, inspection, labor, materials, or other services is between the users entering into that agreement.

Jobsite.world is not a party to such agreements solely because users connected through the Platform.

Before hiring or working with another user, you should independently evaluate:

  • Identity and business legitimacy.
  • Applicable professional licenses and certifications.
  • Insurance and bonding, where appropriate.
  • References, work history, and qualifications.
  • Written contracts, payment terms, project scope, and deadlines.
  • Required permits, inspections, and applicable building codes.

Users are responsible for negotiating and documenting their own agreements and complying with applicable laws.

Unless expressly offered through a separate written agreement, Jobsite.world does not process or guarantee payments, provide escrow services, resolve construction disputes, or guarantee the performance of any user.

10. Professional Licensing and Legal Compliance

Users offering regulated services must comply with all applicable federal, state, and local laws.

This includes, where applicable, contractor licensing requirements, professional engineering and architectural licensing requirements, building codes, permitting requirements, workplace safety rules, and consumer protection laws.

Jobsite.world does not represent that a user’s presence on the Platform constitutes verification, approval, endorsement, or certification of that user.

You are responsible for determining whether you are legally qualified and authorized to perform the services you offer.

11. Intellectual Property Rights

The Platform’s software, branding, design, logos, text, graphics, and other materials owned or licensed by Jobsite.world are protected by applicable intellectual property laws.

Except as expressly permitted by law or authorized by us in writing, you may not reproduce, modify, distribute, sell, publicly display, reverse engineer, or commercially exploit protected Platform materials.

Nothing in these Terms transfers ownership of Jobsite.world’s intellectual property to you.

If you believe content on the Platform infringes your copyright, please contact us using the contact information provided below. Include sufficient information to identify the copyrighted work, the allegedly infringing material, your contact information, and the basis for your claim.

We may remove allegedly infringing content and take appropriate action against repeat infringers. Where applicable, we will follow the requirements of the Digital Millennium Copyright Act and other applicable law.

12. Privacy and Personal Information

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, disclose, and protect personal information.

The Platform may process account information, profile information, project details, uploaded media, communications, and technical usage information as described in that policy.

By using the Platform, you acknowledge that information you choose to publish or share with other users may be accessible to those users and, depending on the feature and settings, potentially to the public.

Do not submit information you are not authorized to share.

We will handle personal information in accordance with our Privacy Policy and applicable privacy laws, including applicable California privacy requirements.

13. Third-Party Services

The Platform may use or link to third-party services, including hosting providers, mapping services, authentication providers, analytics services, and file-storage services.

Third-party services are governed by their own terms and policies. Jobsite.world does not control every aspect of their operation and is not responsible for their independent acts or omissions, except as otherwise required by law.

Your use of third-party services may require you to accept additional terms.

14. Availability, Security, and Changes

We strive to maintain a functional and secure Platform, but we do not guarantee that the Platform will always be available, uninterrupted, error-free, or free of security vulnerabilities.

The Platform may experience maintenance periods, technical failures, service interruptions, or delays.

We may update the Platform, correct errors, change features, or discontinue certain functionality.

You are responsible for maintaining appropriate backups of important information you submit. You should not rely on the Platform as the sole storage location for critical project records or documents.

Nothing in this section excludes any obligation or liability that cannot lawfully be excluded.

15. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

JOBSITE.WORLD DISCLAIMS IMPLIED WARRANTIES TO THE EXTENT LAWFULLY PERMITTED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • THE PLATFORM WILL ALWAYS BE AVAILABLE OR OPERATE WITHOUT ERRORS.
  • PROJECT LISTINGS OR USER PROFILES WILL BE ACCURATE OR COMPLETE.
  • USERS WILL BE QUALIFIED, TRUSTWORTHY, LICENSED, INSURED, OR SUITABLE FOR A PARTICULAR PROJECT.
  • A USER WILL RECEIVE INQUIRIES, OBTAIN WORK, COMPLETE A PROJECT, OR RECEIVE PAYMENT.
  • A CONNECTION MADE THROUGH THE PLATFORM WILL RESULT IN A SUCCESSFUL OR SAFE TRANSACTION.

YOU ARE RESPONSIBLE FOR YOUR OWN DECISIONS AND FOR VERIFYING INFORMATION BEFORE RELYING ON IT.

Nothing in these Terms excludes warranties or rights that cannot be excluded under applicable law.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JOBSITE.WORLD AND ITS OWNERS, OPERATORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF BUSINESS OPPORTUNITIES, OR BUSINESS INTERRUPTION ARISING OUT OF OR RELATING TO YOUR USE OF THE PLATFORM.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOBSITE.WORLD WILL NOT BE RESPONSIBLE FOR DISPUTES, LOSSES, DAMAGES, INJURIES, DELAYS, PAYMENT FAILURES, DEFECTIVE WORK, PROPERTY DAMAGE, OR OTHER CONSEQUENCES ARISING FROM DEALINGS BETWEEN USERS OR FROM CONSTRUCTION SERVICES PROVIDED BY THIRD PARTIES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL LIABILITY OF JOBSITE.WORLD FOR CLAIMS ARISING OUT OF OR RELATING TO THE PLATFORM OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DIRECTLY TO JOBSITE.WORLD FOR THE PLATFORM DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US$100.

This limitation applies only to the extent permitted by law and does not apply to liabilities that cannot legally be limited or excluded. Certain jurisdictions do not permit particular limitations, so some provisions may not apply to you.

17. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Jobsite.world and its owners, operators, affiliates, and personnel from third-party claims, liabilities, damages, judgments, and reasonable legal expenses arising from:

  • Your unlawful use of the Platform.
  • Your violation of these Terms.
  • Your User Content or your infringement of another person’s rights.
  • Your services, projects, contracts, or transactions with other users.
  • Your violation of applicable licensing, permitting, or regulatory requirements.

This section does not require you to indemnify a party for that party’s own negligence, willful misconduct, or other conduct to the extent such indemnification is prohibited by applicable law.

We reserve the right to control the defense of a matter subject to indemnification, in which case you agree to provide reasonable cooperation.

18. Suspension and Termination

You may stop using the Platform at any time. If account deletion is available, you may use the applicable account settings or contact us to request assistance.

We may suspend, restrict, or terminate your access if we reasonably believe that you have violated these Terms, created a security risk, engaged in fraudulent activity, or exposed the Platform or other users to legal or operational harm.

Where reasonably practicable and legally appropriate, we may provide notice or an opportunity to resolve a violation.

Termination does not automatically eliminate obligations or liabilities arising before termination.

Provisions that by their nature should survive termination, including intellectual property, disclaimers, limitations of liability, indemnification, dispute provisions, and accrued obligations, will survive to the extent permitted by law.

19. Changes to These Terms

We may update these Terms from time to time.

When we make material changes, we will take reasonable steps to provide notice, such as posting an updated version on the Platform or providing notice through the service, where appropriate and legally required.

The revised Terms will identify an updated effective date.

Where required by applicable law, we will obtain consent before applying material changes to existing users.

Your continued use of the Platform after revised Terms become effective constitutes acceptance only where such acceptance is legally effective. If you do not agree to the revised Terms, you must stop using the affected services.

20. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles, except where applicable law requires otherwise.

Subject to applicable law, disputes arising from these Terms or your use of the Platform will be brought in the state or federal courts located in California that have jurisdiction over the dispute.

You and Jobsite.world consent to the jurisdiction of those courts to the extent legally permitted.

Nothing in this section limits any mandatory consumer rights or venue protections available under applicable law.

21. General Provisions

Entire agreement. These Terms and any policies expressly incorporated into them constitute the agreement between you and Jobsite.world regarding the Platform.

Severability. If a provision is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

No waiver. Failure to enforce a provision does not waive the right to enforce it later.

Assignment. You may not transfer your rights or obligations under these Terms without our consent, except where such restriction is prohibited by law. We may assign these Terms in connection with a merger, reorganization, financing, or sale of relevant assets, subject to applicable law.

No third-party beneficiaries. Except where expressly stated, these Terms do not create rights for third parties.

Force majeure. We are not responsible for delays or failures caused by events beyond our reasonable control, subject to applicable law.
